Terms of Service

1. Acceptance of Terms

By creating a Sarkit account or using any part of the Sarkit platform (sarkit.nayacloud.com), you agree to be bound by these Terms of Service. If you are registering on behalf of a business, you represent that you have the authority to bind that business to these terms. If you do not agree to any part of these terms, do not use Sarkit.

2. Subscription & Billing

  • Paid plans are billed monthly in advance. Your subscription renews automatically on the same calendar date each month.
  • Prices are in Pakistani Rupees (PKR) and are subject to change with 30 days notice.
  • Payment failure will result in a 3-day grace period, after which your account will be downgraded to limited access. Your data is retained.
  • Refund Policy: Refunds are available within 7 days of the initial subscription payment. After 7 days, no refunds are issued for the current billing period. Cancellations take effect at the end of the current billing cycle.

3. Free Tier Limits

The Free plan is limited to: 1 location, 1 user account, and 100 invoices per calendar month. When you exceed these limits, new transactions will be paused until the next month or until you upgrade. Existing data remains accessible.

4. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current paid billing period. After cancellation, your account will be suspended. You may request full data deletion by contacting sarkit@nayacloud.com, which will be processed within 30 days.

5. Prohibited Use

You agree not to use Sarkit to:

  • Process transactions for illegal goods or services
  • Circumvent, hack, or attempt to gain unauthorized access to the platform
  • Send unsolicited commercial messages (spam) via the WhatsApp integration
  • Resell or sublicense Sarkit to third parties without written authorization
  • Upload malicious code, viruses, or any content that could harm the platform or other users
  • Misrepresent your business identity or engage in fraudulent transactions

Violation of these terms may result in immediate account suspension without refund.

6. Data Ownership

You own all business data you enter into Sarkit, including your product catalog, customer records, sales transactions, and Khata entries. NayaCloud Technologies does not claim ownership of your business data. We are the custodians, not the owners. You may export your data at any time. Our right to use your data is limited strictly to providing the Sarkit service to you.

7. Limitation of Liability

Sarkit is provided "as is." While we strive for 99.9% uptime, we do not guarantee uninterrupted service. NayaCloud Technologies shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use Sarkit, including lost profits or data loss. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes shall be resolved through arbitration in Karachi, Pakistan, under the Pakistan Arbitration Act. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

9. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you via email and in-app notification at least 14 days before material changes take effect. Continued use of Sarkit after the effective date constitutes acceptance of the new Terms.
